No prison time for driver who left scene of fatal accident

A Fort Wayne man who walked away from a crash that left two people dead last year and didn't report it will not spend time in prison.

Justin T. Votaw, 32, was sentenced Friday in Allen Superior Court to three years on home detention, which will be followed by four years of probation. His driver's license was suspended for two years.

Votaw was driving a BMW on West Jefferson Boulevard on Feb. 20, 2017, when he bumped a Volkswagen with Alisa Arseneau, 24, and Jonathan Tracy, 23, inside. The Volkswagen crashed head-on into a Chevrolet Equinox and burst into flames, according to court documents.

Arseneau and Tracy were killed.

Votaw admitted driving the BMW, but it is not clear whether he caused the accident. Prosecutors have said in court filings he bears some responsibility for the wreck.

Votaw pleaded guilty in April to five counts – including three felonies – of leaving the scene of an accident.
