Murder parolee sent back to prison for new counts

Waller

A Fort Wayne man on probation for a nearly 20-year-old murder conviction is heading back to prison after being free a little less than two years.

Harold D. Waller, 36, was given a 10-year prison sentence in Allen Superior Court on Wednesday because he did not maintain good behavior while on probation.

As a 16-year-old, Waller shot and killed fellow teen Johnny Townes Jr. to keep him from testifying in a court case, police said in 1993.

Waller received $3,000 for killing Townes, court records said.

After pleading guilty to the killing, Waller received a 40-year prison sentence with 10 of those years suspended. Inmates are give a day of credit for each day of good behavior, potentially cutting their sentences in half.

Since his release from prison in April 2011, Waller has been charged with felony resisting law enforcement in Elkhart County and misdemeanor false informing in Allen County.

Wednesday, his probation was revoked for failure to maintain good behavior, and he was ordered to serve the suspended part of his initial sentence, according to court documents.
