Passenger hurt in crash; DWI alleged

A drunken driver ran into a fallen tree last week in Fort Wayne, and his passenger broke his neck in the crash, according to court papers.

David L. Fincher, 58, was charged Friday with two misdemeanor counts of operating a vehicle while intoxicated and two felony counts of operating a vehicle while intoxicated causing serious bodily injury.

The night of June 30, Fincher crashed into a tree lying in the road near the corner of Oxford Street and South Park Drive, according to court papers.

The tree broke the windshield and hit Fincher’s front-seat passenger, Rennel Hood Jr. of Fort Wayne, in the head, breaking his neck, knocking him out and giving him a deep cut on his face, according to court documents.

An officer noted that Fincher’s breath smelled strongly of an alcoholic beverage. In the center console of the vehicle, police found a can of beer three-quarters full, court papers stated. A breath test put Flincher’s blood-alcohol level at 0.16 percent, twice the legal limit, court papers said.

Fincher, of the 4700 block of Barrington Drive, posted a $6,500 bond and was expected to be released from custody Friday night.
